Which was why I started this thread:) So that devs could decide on a hard rule of a substitute roll.

For diplomacy
In negotiations, participants roll opposed Diplomacy checks, and the winner gains the advantage. Opposed checks also resolve situations when two advocates or diplomats plead opposite cases in a hearing before a third party.
For intimidate
Your Intimidate check is opposed by the targetÂ’s modified level check (1d20 + character level or Hit Dice + targetÂ’s Wisdom bonus [if any] + targetÂ’s modifiers on saves against fear).
You gain a +4 bonus on your Intimidate check for every size category that you are larger than your target. Conversely, you take a -4 penalty on your Intimidate check for every size category that you are smaller than your target.
